HAPI Trails Horse Adoption Program Inc (“HAPI Trails”) is here to provide you with any support you may need to help this adoption be a success, and we hope that this is just the beginning of your relationship with HAPI Trails.   • 1.1. This Agreement must be fully executed by both parties prior to or at the time the Horse departs HAPI Trails’ premises. The adoption includes a 30-day trial period beginning on the date the Horse departs HAPI Trails’ premises and this Agreement is executed.

(Trial Start Date must match the date the Horse departs HAPI Trails’ premises.)

Adopter shall pay a nonrefundable deposit, in an agreed-upon amount, at the time of Horse pickup.

  • The Adopter understands that the remaining balance of the adoption fee is due no later than the trial end date noted above. If the Adopter does not complete the adoption following the 30-day trial period, the deposit shall be retained by HAPI Trails and may be treated as a tax-deductible contribution subject to IRS rules. A donation acknowledgment letter will be provided if applicable.
  • 1.3. The Adopter may arrange, at their own expense, for a pre-veterinary check with a licensed veterinarian of their choosing. This examination may occur either on HAPI Trails’ premises before the Trial Start Date, or according to the Adopter’s veterinary arrangements during the trial period. When it comes to the pre-vet check, all vet work sought through this exam is the Adopter’s responsibility. HAPI Trails provides standard veterinary care, in addition to any vet work required while the Horse was in our care. All such veterinary records will be provided to the Adopter.
  • 1.4. If the Adopter does not finalize the adoption, the Horse must be returned within five (5) business days after the end of the trial period, at the latest. It is the owner’s responsibility to transport the Horse to the HAPI Trails property, coordinating the return with HAPI Trails’ staff.
  • 1.5. Legal ownership transfers only after full payment of the adoption fee. Upon transfer, HAPI Trails will provide a fully executed adoption contract, any veterinary records in its possession, breed registration paperwork if applicable, a signed Bill of Sale, and a brand inspection verifying legal transfer of ownership if required by state law. The Bill of Sale (Exhibit A) will not be executed until completion of the trial period and receipt of the full adoption fee.
  • 2.1. Adopter shall provide appropriate shelter from extreme weather, clean water, adequate nutrition, and regular veterinary, dental, and farrier care.
  • 2.2. Adopter shall maintain a safe turnout area with secure fencing and provide appropriate social interaction with other equines or suitable companion animals, unless advised otherwise by a veterinarian.
  • 2.3. Adopter shall use humane handling techniques and shall not subject the Horse to abuse, neglect, or training methods involving intimidation or pain.
  • 2.4. Adopter shall not breed, auction, or send the Horse to slaughter or for experimentation.
  • 2.5. Adopter shall use the Horse only for activities suitable to its known health, temperament, and training.
  • 2.6. Adopter shall notify HAPI Trails of any significant injury, illness, death, or change in the Horse’s location or condition, as is reasonable.
  • 2.7. If the Adopter rehomes the Horse, they shall notify HAPI Trails in advance and provide new owner contact information, as is reasonable.
  • 2.8. If the Adopter is no longer able to care for the Horse, they shall contact HAPI Trails to discuss return or rehoming options.
  • 2.9. The Horse is being adopted for the Adopter personally and not on behalf of another individual, organization, or third party.
  • 2.10. Adopter affirms that they are at least twenty-one (21) years old.
  • 2.11. Right of Recovery. HAPI Trails reserves the right to immediately reclaim the Horse without refund if, in its sole discretion, the Horse is found to be neglected, abused, or if the Adopter materially breaches any part of this Agreement.
  • 3.1. If the Adopter is renting the property where the Horse will be housed, they must provide written proof of the landlord’s consent and contact information. HAPI Trails may contact the landlord to confirm approval before the Horse departs.
  • 3.2. The Adopter must provide a description of an alternate housing arrangement, approved by HAPI Trails, to be used if access to the rental property is lost. HAPI Trails may contact the owner of the alternate property to confirm approval.
  • 3.3. The Adopter remains fully responsible for the Horse’s care and housing regardless of changes in rental status. If housing is lost or landlord consent is revoked, the Adopter must immediately notify HAPI Trails and either (a) relocate the Horse to the approved alternate location or (b) return the Horse per the Return Policy. No portion of the adoption fee shall be refunded in such cases.
  • HAPI Trails may provide transportation assistance for the delivery or return of the Horse, subject to advance request and approval. If provided, transportation will incur an additional fee based on the current federal mileage reimbursement rate published by the IRS at the time of service. Transportation is not guaranteed and is dependent on the availability of vehicles, volunteers, distance of transport, and safe weather or road conditions.
  • 5.1. During the 30-day trial period, Adopter agrees to permit HAPI Trails staff, board members, or designated representatives to conduct scheduled or unscheduled site visits at reasonable times to observe the Horse’s condition and care.
  • 5.2. After the trial period, Adopter agrees to provide written progress updates on the Horse’s condition and adjustment at 30 days, 60 days, and 90 days following adoption, and again at 6 months and 1 year, via email to HAPI Trails.
  • If the Horse is returned after the trial period, no refund of the adoption fee will be issued, and those funds are not eligible for a charitable contribution receipt. The return may impact future adoption eligibility, depending on circumstances.
  • Adopter acknowledges that horses are inherently unpredictable and assumes full responsibility for the Horse’s behavior, care, and any resulting damage or injury, during and after the Trial Period.
  • 8.1. Adopter agrees to release, indemnify, and hold harmless HAPI Trails, its staff, volunteers, and board members from any claims or damages arising out of or related to the Horse.
  • 8.2. Legal jurisdiction for any disputes under this Agreement is the State of Idaho.
  • 8.3. Mediation is required as the first step in resolving any disputes.
  • 8.4. Adopter is responsible for HAPI Trails’ legal fees if the organization must enforce any term of this Agreement or if the Adopter brings legal action against the organization.
  • Adopter grants HAPI Trails the right to use photos or videos of the Horse for educational, promotional, or fundraising purposes without compensation.
  • The Horse is adopted “as is.” HAPI Trails makes no warranties as to the Horse’s health, training, behavior, or suitability for any specific purpose.
  • This document constitutes the entire agreement between the parties. No oral representations or modifications shall be binding unless in writing and signed by both parties.
  • If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalidity of any one section shall not affect the validity of the remainder of the Agreement.
  • All terms of this Agreement remain binding and enforceable after legal ownership of the Horse transfers to the Adopter, except where a provision is expressly limited to the trial period.
  • Attached hereto and incorporated by reference is Exhibit A – Horse Bill of Sale, which shall be executed upon completion of the adoption and full payment of the adoption fee.

This agreement constitutes an offer of adoption by HAPI Trails. Your signature on this agreement shall constitute your acceptance of the offer, and this agreement shall be binding on you and HAPI Trails upon your signing this agreement.
